TERMS AND CONDITIONS | ONLINE SERVICES 

Operation of Terms and Conditions 

1. These terms and conditions apply to all users of Online Services under New Zealand National Fieldays Society Inc (“NZNFS”) and associated brands. 
2. Online Services apply to the website (including online ticket sales), registration and use of the Fieldays App and Smart Bands, all operated by NZNFS. 
3. The general terms and conditions apply to the Online Services listed in clause 2 above. 
4. Specific terms and conditions relating to individual Online Services are provided below. 
    

Definitions
In these terms and conditions (Terms and Conditions), the following definitions will apply:
“Device” means any registration device, exhibitor Smart Band Scanner, the Fieldays App or any other registration device used by NZNFS at an event operated by NZNFS.
“Exhibitor” means an official Fieldays exhibitor who has been approved to exhibit at Fieldays and has accepted NZNFS’s relevant exhibitor terms and conditions.
“Fieldays” means the event operated by NZNFS known as Fieldays.
“Fieldays App” means the official app in relation to Fieldays which can be downloaded from the Apple App Store or Google Play.
“Online Services" means all services provided on NZNFS websites, Devices, Fieldays App, Smart Band including but not limited to ticket sales and website, Device and Fieldays App registration.
“Smart Band” means the official Fieldays band provided to you by NZNFS when you enter Fieldays which allows you to interact with Apps and Exhibitors in accordance with NZNFS’ Privacy Privacy Policy and NZNFS terms and conditions notified to you from time to time.
“Venue” means the venue located at Mystery Creek and owned and operated by NZNFS.
“you” or ‘your” means event attendees, the general public and any other third parties that access NZNFS websites, Apps and events.
 

General Terms and Conditions

1. The use of information and materials through Online Services is at the users own risk. 
2. Online Services are subject to copyright, and unauthorised use is not permitted. 
3. NZNFS is not responsible for any content contained in any third-party hyperlink accessed through Online Services. 
4. Online Services are not to be used to breach any legislation or to be used for any unlawful purposes, including but not limited to, the introduction of spam, viruses or other harmful items which may interfere with the system or network. 
5. The use of Online Services is subject to the laws and jurisdiction of New Zealand. 
6. NZNFS is the owner of all intellectual property rights in its trademarks, copyright and other intellectual property subject to the New Zealand Copyright Act 1994.
7. All personal information collected through Online Services is subject to the Privacy Act 2020 and the NZNFS Privacy Policy which is located at this link acceptance of these Terms and Conditions is acceptance of the NZNFS Privacy Policy.
8. Subject to the NZNFS Privacy Policy, data collected (excluding personal information) may be used and disclosed for any of its purposes. 
9. If you have any questions regarding privacy and personal information held by NZNFS, then please contact the NZNFS Privacy Officer at privacy@nznfs.co.nz
10. In the event of a dispute between parties, NZNFS will seek to resolve such dispute and if unable to come to a resolution use mediation or other informal methods of resolution before pursuing resolution through the Courts. 
11. You are not permitted to use any of NZNFS’s trade marks, trade names, logos, devices or bylines without prior written consent. 
12. Access to Online Services may be terminated or suspended at any time by NZNFS without notice. 
13. NZNFS reserves the right to amend these terms and conditions published on our website from time to time effective immediately. 
14. Login credentials are unique to the individual and/or organisation and are not to be shared with any other person. 
15. Online Services may be temporarily suspended from time to time for maintenance. 
16. Information contained within the website is for general purposes only. 
17. Links to affiliate websites should not be construed as an endorsement, approval or recommendation for any information, graphics, materials, products, or services referred to on those affiliate sites. If you access any links to a third party website please ensure you review privacy information and terms and conditions of that third party.
18. NZNFS will not be liable for any delay or failure to perform any obligations, including but not limited to, Online Services provided that such failure is beyond the reasonable control and without fault or negligence of NZNFS.
19. Content hosted through Online Services is subject to change without consent. 
     

Specific Terms & Conditions

Online Ticket Sales

1. Online ticket purchase transactions are encrypted to the extent reasonably possible to ensure a secure internet transaction. 
2. Payment shall be made by credit card such as Visa, MasterCard or American Express. 
3. Where you are purchasing a ticket for any individual other than yourself, you agree that you have obtained the express consent of that individual to include their personal information on their ticket and agree to the terms and conditions and the NZNFS Privacy Policy on their behalf. NZNFS will not be liable in respect of the personal information of a third party being included on a ticket where you have not obtained consent from the individual to use their personal information including in relation to being entered into any prize draw or competition.
4. The ticket price and fees are in NZ dollars and are inclusive of GST which may be subject to transaction fees and replacement ticket fees.
5. Electronic tickets must be printed or presented on your electronic device. 
6. If printing your ticket, black ink on white paper is required to enable the ticket barcode to be scanned. 
7. Each electronic ticket has a unique barcode which allows one entry only to the Event unless otherwise stated. 
8. Each ticket must be scanned at an authorised entry point. 
9. Entry may be refused if a ticket is damaged or defaced in any way or has been purchased from a third party. 
10. NZNFS does not permit the resale of tickets or their use for advertising, promotional or other commercial purposes including competitions, trade promotions, auctions, prizes, sweepstake, or other purposes without prior written consent. 
11. NZNFS may amend these Terms and Conditions at any time by updating them and displaying them on the NZNFS website and Fieldays App. Any variations will only apply to ticket purchases made after the effective date of the updated terms and conditions. If you do not agree with any revised version of these Terms and Conditions, or you cannot comply with it, then you must not access or use any Online Services.
12.  If a ticket is sold or used in breach of clause 10 above, the ticket may be cancelled without a refund or compensation and the bearer of the ticket may be refused admission to any event. 
13. Conditions of entry are referenced to on the ticket and in the terms and conditions of entry to the Event located at this link.
14. This ticket cannot be exchanged or refunded except at the discretion of NZNFS.
    15. If the event is postponed to an alternative date, no refunds will be issued, and your ticket will still be permitted for use on the revised date(s).
15.  If an Event is cancelled you must apply for a refund within a reasonable time. NZNFS does not offer refunds or exchanges as a result of a change in your personal circumstances.

TERMS AND CONDITIONS | ENTRY TO EVENT

Fieldays is owned and operated by New Zealand National Fieldays Society Inc. (NZNFS), a not-for-profit organisation. The right to admission is subject to NZNFS full ticket terms and conditions, at www.fieldays.co.nz.

• This ticket cannot be exchanged or refunded except at the discretion of NZNFS.
• NZNFS may impose restrictions on entering our premises without notice.  
• By entering you acknowledge and agree that you shall comply with NZNFS’s policies, procedures, and directions to manage the risks to public health and safety. It may be a condition of entry to that a search of a person and/or their possessions will be required at the time of entry to the venue.  
• The Fieldays Smart Band is optional to accept and register your details against. NZNFS reserves the right to limit interactions to activated users.
• Tickets may be refused if damaged, defaced or are not purchased from authorised points of sale.
• Visitors are prohibited from bringing alcohol, illegal substances, animals, bicycles or scooters onto the site or any other item prohibited by NZNFS from time to time.  If visitors are advised to not bring an item onto the site and refuse or are found to have these prohibited on site, they will be asked to leave immediately. Please note that this exclusion does not apply to mobility scooters where approved entry by NZNFS.  
• Admission of “service animals” is at the discretion of NZNFS.  
• NZNFS reserves the right to add, withdraw, reschedule, or substitute artists and/or vary advertised programmes, venues, seating arrangements and audience capacity as it sees fit.  
• Admission may be denied to an Event or Venue where any age or other entry restriction is in place if valid identification for that entry reason is requested and cannot be provided.  
• Persons entering the venue do so at their own risk. To the maximum extent permitted by law, NZNFS and the ticket seller shall be under no liability whatsoever to persons entering the venue or any third party, any injury, loss, damage or harm to any person or property arising from attendance at the event or site.
• NZNFS reserves the right to revise or amend ticket terms and conditions of sale without notice.
• You consent to any image of you on site being used for reasonable publicity purposes by NZNFS and authorised media.
• Acknowledge that drones (remotely piloted aircraft systems) may be operating in and around the site. No unauthorised drone operation is permitted.  
• You agree that perpetual use may be made, free of charge, of his/her voice, image and likeness while at the Venue by means of live or recorded video, photographs or other use of media technologies.  
• If the event is postponed to an alternative date, no refunds will be issued, and your ticket pass will still be permitted for use on the revised date(s).  
• If an event is cancelled you must apply for a refund within a reasonable time. NZNFS does not offer refunds or exchanges as a result of a change in your personal circumstances. 

TERMS AND CONDITIONS | WIN A 2024 ISUZU D-MAX

1. Information on how to enter and prize details form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. 
2. The Promoter is New Zealand National Fieldays Society, 125 Mystery Creek Road, Ohaupo, New Zealand (“Promoter”).  
3. Multiple entries permitted, subject to the following: a) only one (1) entry permitted per ticket personalisation; and b) scanning your band at the Isuzu Utes New Zealand Ltd site F70.  
4. By accepting these terms and conditions you consent to your details to be passed onto Isuzu Utes New Zealand Ltd and the Isuzu Utes Privacy Policy will apply. This is available at www.isuzuutes.co.nz/privacy-policy  
5. The Promotion will commence on 12/06/2024 and will continue until 4.00pm NZDT on 15/06/2024 (“Promotion Period”). 
6. To be eligible to enter, you must: 
   a) have personalised your Fieldays ticket with your details during the Promotional Period; and
   b) Be a New Zealand citizen or permanent resident. 
7. Entry is only open to individuals located in New Zealand and entrants must be over the age of 18 years of age on the 11^th June 2024.  
8. Directors, management and the employees of New Zealand National Fieldays Society, Satellite Media and Isuzu Utes New Zealand Limited (Prize Supplier) including the prize suppliers’ dealers and ambassador network and the immediate family members of those individuals are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin.  
9. The Promoter reserves the right, at any time, to verify the validity of entries, and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion.  
10. Incomplete or indecipherable ticket details will be deemed invalid. 
11. There will be one (1) prize draw for this Promotion. Prize will be drawn under independent supervision prior to close of business on the 31^st August 2024.  
12. The Promoter may draw additional reserve entries and record them in order in case an invalid entry is drawn.  
13. The winner will be notified by telephone or email.  
14. The winner will be notified as soon as possible following the draw. Reasonable efforts will be made to contact the prize winner using the information provided. The promoter reserves the right to redraw if a winner cannot be contacted within a reasonable period, as determined by the Promoter.  
15. The first valid entry drawn will win a D-MAX LX Double Cab 4WD in Obsidian Gray, valued at $63,990 plus on-road costs (including GST).  
16. Prize includes one-year vehicle registration and on-road costs (including the first 5,000km Road User Charges, 12 Month Registration, Full Tank of Diesel, 3 Year/100,000 KM Warranty. Insurance, additional options, fuel and all other ancillary costs are the responsibility of the winner. The vehicle is to be collected by the winner from Isuzu Utes New Zealand Ltd or the nearest local Isuzu Utes dealership to the winners location.  
17. The Promoter reserves the right to substitute to a similar alternative of equal or greater value in the event of circumstances outside its control.  
18. The prize is not transferable or exchangeable and cannot be taken as cash. If for any reason the winner does not take the prize, then the prize will be forfeited. 
19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and the Prize Supplier. Entry is conditional on providing this information. 20. The Promoter reserves the right to update these Terms and Conditions at any time.  

TERMS AND CONDITIONS | FIELDAYS EXHIBITOR NETWORKER

Fieldays is owned and operated by New Zealand National Fieldays Society Inc. (NZNFS), a not-for-profit organisation. The right to admission is subject to NZNFS full ticket terms and conditions, at www.fieldays.co.nz.

• This ticket cannot be exchanged or refunded except at the discretion of NZNFS. 
• Tickets may be refused if damaged, defaced or are not purchased from authorised points of sale. 
• Persons entering the venue do so at their own risk. To the maximum extent permitted by law, NZNFS and the ticket seller shall be under no liability whatsoever to persons entering the venue or any third party, any injury, loss, damage or harm to any person or property arising from attendance at the event or site. 
• NZNFS reserves the right to revise or amend ticket terms and conditions of sale without notice. 
• You consent to any image of you on site being used for reasonable publicity purposes by NZNFS and authorised media. 
• You agree that perpetual use may be made, free of charge, of his/her voice, image and likeness while at the Venue by means of live or recorded video, photographs or other use of media technologies.  
• If the event is postponed to an alternative date, no refunds will be issued, and your ticket pass will still be permitted for use on the revised date(s).  
• If an event is cancelled you must apply for a refund within a reasonable time. NZNFS does not offer refunds or exchanges as a result of a change in your personal circumstances. 
• Tickets are sold on a first-come, first-served basis, subject to availability. 
• This ticket is restricted to Fieldays Exhibitors and Suppliers only. 
• NZNFS reserves the right to revoke any ticket(s) believe to be purchased over and above acceptable quantities. Revoked tickets will not be valid for entry to the event. 

TERMS AND CONDITIONS | VIP BUSINESS PLUS TICKET

Fieldays is owned and operated by New Zealand National Fieldays Society Inc. (NZNFS), a not-for-profit organisation. The right to admission is subject to NZNFS full ticket terms and conditions, at www.fieldays.co.nz.

• This ticket cannot be exchanged or refunded except at the discretion of NZNFS.
• NZNFS may impose restrictions on entering our premises without notice.  
• By entering you acknowledge and agree that you shall comply with NZNFS’s policies, procedures, and directions to manage the risks to public health and safety. It may be a condition of entry to that a search of a person and/or their possessions will be required at the time of entry to the venue.  
• The Fieldays Smart Band is optional to accept and register your details against. NZNFS reserves the right to limit interactions to activated users.
• Tickets may be refused if damaged, defaced or are not purchased from authorised points of sale.
